Both the Spanish Ley de Enjuiciamiento Civil (civil procedure law) and the Ley de Enjuiciamiento Criminal (criminal procedure law) consider the figure provided by the independent expert who values the property.

Such expert witnesses must be duly qualified and hold the corresponding title and diploma.

The appointment of such experts can be decided by the parties; the courts may also appoint such an expert.
